Booking Terms and Conditions

POWER on Ice, 17th December 2022 (The Event)

 

The Event, held at Portsmouth on Ice (The Site) is organised and managed by POWER Fitness Events, a business based in Chichester, West Sussex, UK.

By attending and participating in The Event you agree to accept and abide by POWER on Ice Booking Terms and Conditions including standard booking Booking Terms and Conditions that follow these specific POWER on Ice Booking Terms and Conditions.

Furthermore, by  attending and participating in The Event you agree to accept and abide by any venue rules of Portsmouth on Ice as stated here: https://portsmouthiceskating.uk/terms-and-conditions/ and any other regulations provided on entry to The Site).

  • Access onto the ice, during The Event, is restricted to The Ride Coach, The Rider, Event-assigned POWER Fitness Events staff and Event-assigned Portsmouth on Ice staff. The Ride Coach reserves the right to refuse access onto the ice, at any time, and such decision is immediate and final.  

  • The safety of The Rider, is the responsibility of POWER Fitness Events, whilst the static bikes and all equipment provided by POWER Fitness Events is on the ice.

  • The Rider must follow the instructions of the Ride Coach and/or POWER Fitness Events staff and/or Portsmouth on Ice staff and/or marshals, at all times.

  • The Rider is prohibited from accessing the ice until instructed to do so by The Ride Coach.

  • The Ride Coach will be responsible for positioning the bikes on the ice. The Rider must not attempt to re-position their bike on the ice.   

  • Transitioning onto and across the ice to/from the location of the static bikes, mounting and dismounting a static bike on ice, riding a static bike on ice, and ice skating can be hazardous. Participation in The Event is entirely at The Rider’s own risk. Other than by proven negligence, POWER Fitness Events is not liable for any injury, illness, or death of The Rider arising from their participation in the Event.

  • Other than by proven negligence, POWER Fitness Events is not liable for any loss, damage or injury occurring to The Rider arising from their transition on-foot across the ice to the location of the static bikes, the use of the static bike or any equipment that is provided by POWER Fitness Events, on the ice.

  • Portsmouth Ice Rink is continually kept in extremely cold conditions, The Rider is advised to dress accordingly.

  • Other than by proven negligence, POWER Fitness Events is not liable for any loss, damage or theft of any property of The Rider.

  • The Ride Coach and/or POWER Fitness Events staff and/or Portsmouth on Ice staff and/or marshals reserve the right to remove those deemed a risk to the safety of others.

  • The Site may use lighting that triggers seizures for people with photosensitive epilepsy. Rider discretion is advised. 

  • If having booked and paid for The Event, The Rider is unable to attend, notice of cancellation should be given online, using the app, or by emailing hello@powerfitnessevents.com as soon as possible. The Event is non-refundable within 7 calendar days of the ride. 

 

Standard booking Terms And Conditions.

 

Definitions

In reading these booking Terms and Conditions the following definitions apply:

 

The Rider is the participant in The Event who has completed the booking form – online or by other means - and paid the relevant fee.

The Event is the ride which The Rider has booked and which is delivered in accordance with these booking Terms and Conditions.

The Ride Coach is the designated person from POWER Fitness Events who is responsible for conducting the ride.

The Rider

The Rider must be 18 years of age or older and, by making a booking, are verifying that they meet the minimum age requirement (except with a written waiver by a parent/guardian if rider meets minimum height requirement of 4' 9"/145cm).

On the occasion of the booking, and at any time up to including The Event and whilst it is in process, The Ride Coach may exclude The Rider from The Event, for whatever reason, and such decision is immediate and final.

Other than by proven negligence, POWER Fitness Events is not liable for any loss, damage or injury occurring to The Rider arising from the use of the static bike, or by using other facilities and equipment that is provided by POWER Fitness Events.

Health and Safety.

The safety and well-being of The Rider is a priority for POWER Fitness Events. In order to ensure this it is important for The Rider to follow any procedural guidelines provided for The Event – in respect to, for example, the setting up and operation of the static bikes and to comply with all reasonable instructions issued by The Ride Coach.

The Ride Coach will advise of the procedure in the event of emergency; including fire exits and assembly points as appropriate to the venue.

The Rider should eat sensibly before and after the ride and ensure they keep themselves hydrated throughout; including bringing their own water bottles to the ride. The Rider must wear appropriate clothing and footwear during The Event.

The static bikes used by POWER Fitness Events provide The Rider with the opportunity to enjoy different levels of physical exertion, but in general the events involve intense exercise. Riders should not participate if they are not fit to do so. If The Rider has any illness or medical condition which may affect their capacity to undertake The Event safely they should consult The Ride Coach beforehand; or, if they feel ill during the ride, they should stop immediately and advise The Ride Coach whose decision is final in relation to whether The Rider can continue to participate. In making such a decision The Ride Coach is not holding themselves out as having any specific expertise, but is merely making a considered decision on the facts, based on the precautionary principle. If the Rider is in any doubt as to their physical fitness to ride they should consult a medical expert.

POWER Fitness Events will endeavour, at all times, to keep The Rider safe, but inevitably such exercise incurs a risk to The Rider of minor and sometimes major injury and, for some people, the loud music through heads will pose health risks. POWER Fitness Events are not responsible for such injuries unless negligence is proven.

 

Filming/Photography:

 

Please note that CCTV and cameras may be present at The Event. By attending in the Event, attendees consent to being photographed, filmed and/or recorded, and consent to the image or recording of them (including any images or recordings taken by them within The Event) being used in distribution (commercial or otherwise) in perpetuity without any payment. All sound and moving or still picture rights including, without limitation, on the internet, vest exclusively with POWER Fitness Events (or by any third party as may be engaged by POWER Fitness Events).

 

These Booking Terms and Conditions are current as of 3rd December 2022. If subsequent versions are produced they will be suitably publicised to relevant persons.
